It shall be unlawful for any person to manufacture, sell, or offer for sale, discharge or possess fireworks of any type, or to permit any such violation, unless a permit has been issued for professional pyrotechnic display by the Fire Marshal’s Office and Special Events Planning Office.
The display of fireworks, including proximate audience displays and pyrotechnic special effects, shall comply with the 2006 International Fire Code, NFPA 1123, NFPA 1126 and Fire Code Ordinance.
A Fire Permit Application must be completed and the following information provided in writing within thirty (30) days in advance of the outdoor fireworks display date. A fee of $50.00 will be assessed plus an additional fee for standby personnel.
1. The date, start and end time of the outdoor fireworks display.
2. Property owner name, address, email address and phone number with notarized letter granting permission for use of the property for outdoor fireworks display.
3. The name, address, email address, and phone number of the individual, group, or organization sponsoring the outdoor fireworks show.
4. The name, address, email address, and phone number of the exhibitor/operator and a copy of a valid State of Texas Pyrotechnic Operator License or a Pyrotechnic Special Effects License.
5. The name, address, email address, and phone number of the supplier of the fireworks, if different from that of the operator.
6. Names, number of assistants, spotters and monitors (Minimum age 18).
7. Proof of State Permit application shall be provided.
8. Proof of liability insurance.
9. A site plan containing the following information:
a. The location and dimension of the discharge site, display site, fallout area.
b. The location and distance to spectators viewing areas, buildings,
highways, overhead obstructions, parking, and other objects in the area.
c. The location of access and control points behind which the audience is
d. The location of emergency vehicle staging area and access routes.
e. The location of fireworks storage area prior to display.
10. The number, sizes, firing methods, types of pyrotechnic devices and materials to be discharged.
1. A site inspection is required after submittal of permit.
2. Standby personnel are required for all outdoor fireworks displays. The number of standby personnel and level of fire protection will be determined by the Fire Chief.
3. There shall be a member of the pyrotechnic company on site at all times once fireworks have been delivered. The site shall be secured from public entry by at least 100 feet, during storage and preparation.
4. Fireworks shall be kept dry.
5. Shells shall be inspected by the operator after delivery to the display site. Shells having tears, leaks, broken fuses or sign of having been wet shall not be fired.
6. There shall be no smoking or matches permitted in the area of storage or display site.
7. No fireworks display shall be held during any windstorms in which the wind reaches 15 mph.
8. Security personnel and barriers shall be provided around the display area to aid in crowd control.
9. If the Fire Official or the pyrotechnic operator determines that there is lack of crowd control or that the crowd is in danger, the display shall be stopped.
10. If at any time high winds, weather conditions or other adverse conditions exist, the display shall be stopped.
11. Fire extinguishers are required at fireworks display and storage.
12. A post-display inspection of the site shall be conducted. This inspection shall be conducted before public access to the site shall be allowed.
13. Fireworks and pyrotechnic material shall be fired only when security, monitors, spotters, fire and emergency personnel are in place and the display site is clear and secure.
14. All necessary safety equipment shall be worn within the discharge site during firing.
